1. Scope & Acceptance of Terms
These Terms of Use and Regional Compliance Policy ("Agreement", "Policy") constitute a legally binding agreement between Hasib ERP ("Hasib", "Platform", "we", "us", or "our") and the enterprise, organization, commercial entity, or individual user ("Customer", "User", "you", or "your") accessing or utilizing the Hasib Enterprise Resource Planning (ERP) platform, including its accounting, inventory management, human resources management (HRM), customer relationship management (CRM), point of sale (POS), supply chain, and automated invoicing modules.
By registering an account, provisioning a multi-company instance, accessing the API, or utilizing any feature of Hasib ERP, you unconditionally agree to be bound by this Agreement and all statutory regional compliance requirements established herein. If you are accepting on behalf of an organization or legal entity, you represent and warrant that you possess full legal authority to bind such entity.
2. Regional Statutory Compliance Framework
Hasib ERP is engineered from the ground up to ensure strict, automated legal and regulatory compliance across its primary operational jurisdictions: Egypt, the Kingdom of Saudi Arabia, the United States of America, and the United Arab Emirates. Each jurisdiction imposes distinct statutory mandates regarding financial reporting, electronic invoicing, personal data protection, cybersecurity, and commercial book-keeping.
2.1 Egypt Regulatory & Legal Compliance
Compliant with Egyptian Laws & ETA Regulations⚖️ Egyptian Personal Data Protection Law (Law No. 151 of 2020)
Hasib ERP operates in strict adherence to Law No. 151 of 2020 regulating the protection of personal data in the Arab Republic of Egypt. All processing of employee, vendor, and customer personal data is executed under lawful, legitimate grounds with end-to-end data encryption. Data subjects in Egypt retain the right to access, rectify, restrict processing, and request the deletion of their personal records within statutory limitations.

Commercial Books & Records Retention (Egyptian Commercial Code No. 17 of 1999)
Hasib ERP maintains financial ledgers, journal entries, and inventory movements for the statutory retention period of no less than five (5) years in compliance with Egyptian commercial accounting mandates.
2.2 Kingdom of Saudi Arabia (KSA) Regulatory Compliance

Personal data of Saudi citizens and residents is processed in accordance with the PDPL and regulations promulgated by the Saudi Data and Artificial Intelligence Authority (SDAIA). Hasib enforces strict tenant segregation, role-based access control (RBAC), and sovereign cross-border data transfer safeguards.
Anti-Cyber Crime Law (Royal Decree No. M/17) & E-Commerce Law (Royal Decree No. M/126)
Use of Hasib ERP for unauthorized interception, illegal financial ledger manipulation, or fraudulent electronic commerce transactions constitutes a criminal offense under Saudi Law.

General ledgers, journal entries, and balance sheets generated within Hasib conform to Saudi GAAP / SOCPA (Saudi Organization for Chartered and Professional Accountants) accounting standards with a mandatory ten (10) year retention capability.

We do not "sell" or "share" customer personal information as defined by applicable US state privacy laws.

Hasib ERP software and services are subject to United States Export Administration Regulations (EAR, 15 C.F.R. Parts 730-774) administered by the Bureau of Industry and Security (BIS) and economic sanctions administered by the Office of Foreign Assets Control (OFAC, 31 C.F.R. Part 500 et seq.). Customer warrants that neither Customer nor any authorized user is listed on any US Government sanctioned persons list (including the Specially Designated Nationals (SDN) list) or located in an embargoed destination.
Internal Revenue Code (IRC) & GAAP Financial Record Retention
Hasib ERP provides complete, immutable audit logs compliant with IRS electronic recordkeeping standards (IRS Rev. Proc. 98-25 and IRC § 6001). Users are empowered to maintain double-entry GAAP-compliant financial records for state sales tax reporting, federal corporate tax filings, and independent CPA audits for at least seven (7) years.
Digital Millennium Copyright Act (DMCA) & Intellectual Property
Hasib complies with 17 U.S.C. § 512 (DMCA) and maintains standard procedures for prompt response to notices of alleged intellectual property infringement.
2.4 United Arab Emirates (UAE) Regulatory Compliance

Electronic Transactions & Trust Services (Federal Decree-Law No. 46 of 2021)
Electronic purchase orders, sales quotations, and digital approvals generated through Hasib ERP carry full evidentiary weight and legal validity pursuant to UAE electronic transactions legislation.
3. Acceptable Use & Prohibited Conduct
Hasib ERP is granted exclusively for legitimate commercial, operational, and managerial accounting activities. You agree that you will not, directly or indirectly:

We implement defense-in-depth enterprise security controls to protect the confidentiality, integrity, and availability of Customer data:
🔐 Encryption Standards: All customer data in transit is protected using TLS 1.3 encryption. Stored databases, automated backups, and sensitive financial credentials are encrypted at rest using AES-256 standards.
🏢 Multi-Tenant Segregation: Every enterprise tenant and company instance is logically partitioned with strict database query scoping preventing cross-tenant data leakage.
👥 Role-Based Access Control (RBAC): Fine-grained permission architecture ensuring company administrators maintain absolute control over who can view, post, approve, or void financial transactions.
📦 Data Ownership: The Customer remains the sole and exclusive owner of all commercial records, accounting journals, customer databases, employee records, and inventory data entered into Hasib ERP.
5. Financial Accuracy & Audit Trail Responsibilities
While Hasib ERP provides automated posting rules, double-entry bookkeeping safeguards, and tax calculation engines:
6. Intellectual Property & Software License
All software architecture, source code, user interface designs, database schemas, trademarks, logos, and documentation related to Hasib ERP are the exclusive intellectual property of Hasib and its licensors. Subject to timely payment of applicable subscription fees and continuous compliance with this Agreement, Hasib grants the Customer a non-exclusive, non-transferable, revocable license to access and use the ERP services during the subscription term.
7. Service Availability, Backups & Disaster Recovery
Hasib ERP targets an annual service availability uptime of 99.9% excluding scheduled maintenance windows announced in advance. Automated encrypted daily backups are maintained across geographically redundant data facilities. We maintain comprehensive business continuity and disaster recovery procedures to ensure operational resiliency.
8. Disclaimer of Warranties & Limitation of Liability
To the maximum extent permitted by the applicable laws of Egypt, KSA, the United States, and the UAE:
HASIB ERP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED ERROR-FREE OPERATION.
IN NO EVENT SHALL HASIB ERP, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE PLATFORM.
HASIB ERP'S TOTAL AGGREGATE LIABILITY UNDER ANY LEGAL THEORY SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY CUSTOMER TO HASIB ERP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
9. Termination & Data Portability
Upon termination or expiration of your subscription, you retain the right to export your complete financial records, customer databases, general ledgers, and transaction logs in standard formats (PDF, Excel/CSV, JSON) for a grace period of thirty (30) days. Following the expiration of the grace period and subject to statutory legal record retention requirements, Hasib will securely purge or anonymize Customer instance data in accordance with our data destruction protocols.
